Just playing devil's advocate....
1. How would auditors or opposing counsel know these were not scanned from
the originals? If you have a process that, say, marks the photocopies as
such, I could see that - but you could document that process. That does
speak to a deeper issue, perhaps...
2. If the originals are fragile or damaged you'd have to photocopy them
anyway....

The thing I tell people in my consulting practice and in my CDIA+ classes is
to document the general process and procedures followed. I don't see a
significant difference between scanning a valid photocopy and the original -
after all, visual quality issues notwithstanding, we make copies of copies
as well as copies of originals....
