Meet and Confer Conference DVD Announced

Education is an ongoing process for all of us. In that regard it is
important for all of us to understand that as of December 1, 2006,
the new Federal Rules of Civil Procedure are in effect for all
litigation in Federal courts in the United States. The changes to
the Rules are particularly important regarding electronic records.
This is why Federal District Judge Shira Scheindlin - one of the
most knowledgeable federal judges on the subject of e-records and
author of the Zubulake opinions - was the Keynote speaker at both
the MER and the ARMA conferences this year.

One of the most significant Rule changes is the new "meet and
confer" requirement. Specifically, it calls for all parties to
promptly meet and confer regarding their respective e-discovery
needs. To best understand the "real world" legal and technical
issues regarding this new "meet and confer" requirement, Cohasset
Associates is pleased to announce the availability of an educational
DVD focused on the "meet and confer" issue.

This DVD presentation is a mock pre-trial conference with Judge
Scheindlin presiding and was the landmark Keynote Address at the
recent National Conference on Managing Electronic Records (MER '06).

For those who heard Judge Scheindlin's excellent Keynote
presentation at the ARMA conference, the contents of this 1hr and 42
min DVD are not the same speech; rather, it is a mock pre-trial
conference where Judge Scheindlin presides as experienced plaintiff
and defense counsels present their positions to provide insight and
guidance regarding:

- Expectations of courts
- Issues to anticipate - their diversity, complexity and importance
- Likely attorney/technical expert interactions that will be
required

As such, this DVD is a unique learning experience for judges,
attorneys and records management professionals. The information
presented is essential for all organizations to improve their
readiness for "meet and confer" conferences that will inevitably be
part of future litigation.

Included with every DVD is a helpful guide that contains 1) a
reprint of the relevant new Rules, 2) the hypothetical case that is
the subject of the DVD's "meet and confer" conference, and 3) the
plaintiff's and the defense's joint Report to the Court.

Many different e-records discovery issues are addressed in the
26-part DVD. They include:

- Rule 26(f) Report to the Court
- Volume of Records
- Privilege Waiver
- Discovery Costs
- Data Masking
- Hand Held Devices
- Obsolete Media
- Summary Data vs. All Data
- Discovery Cost Burden
- Proportionality Rules
- Backup Tapes
- 1st & 2nd Tier Discovery
- Tape Labeling
- Voice Mail

Using the DVD's "hot" index, users can easily and rapidly move from
one specific topic to another.

Joining Judge Scheindlin in the Keynote are Ken Withers, Kate
Oberlies O'Leary, John Jessen, Peter Bensinger, Jr., and Craig Ball
who collectively provide a wealth of information and insight on the
required "meet and confer" conferences - a significant new component
of the new world of e-records in litigation and electronic records
management.

Ordering information and excerpts from the DVD are available at:
http://www.merresource.com/dvd.htm.

You also can order by phone at 1-800-200-7667.

I believe you will find this DVD informative, unique and very
timely.
