Gerard, that question is almost toooooo tempting.  I might tend to
provide the customer with a complete listing / inventory of what I
received.  While it is not the new vendor's job to make a big issue out
of a prior vendor's errors, neither is it their job to cover for that
other vendor.  Just playing it straight sounds like the best option.

 (1)     What should the new vendor do if they believe that the old
vendor
has lost their clients records?

This is something that should come through in an inventory report to the
customer...providing them with complete information on what was
received, and reporting any are gaps in that inventory, without
additional comment.

(2)     What should the new vendor do if they find records belonging to
a
3rd party in a delivery for their new client?

Include this in the inventory to the client and ask that client how they
might best deal with tapes not belonging to them.   It would be between
you and the client as to how to notify the party whose tapes were
included in the shipment to you.

(3)     What should be done to ensure the chain of custody reflects the
errors described in (1) and (2)?

The inventory of what you received should deal with this..... You want
to be sure that you've accurately reflected what you received and that
you have your customer's acknowledgement of what you have, so that
you're not on the hook for any lost tapes.
