It's not just a US problem. Every organization, big or small, has
records in one electronic format or another - be it e-mail, in databases
or in some software format (Word, Excel, pdf etc). If you have any
electronic records, then you could face an e-discovery. This session
will dig into the: 
* 
legal drivers behind e-discovery 
* 
breadth a discovery search might encompass, even with a small
organization 
* 
ever increasing role e-documents play in that discovery process, even in
Canada 
* 
importance of clear communication with IT and RIMS departments 
* 
crucial need to work together with all affected departments (IT, RIMS
etc.) to ensure the capture of all relevant e-records 
* 
Sedona Canada Principles, a pioneering effort to state fundamental
concepts for e-discovery applicable to a wide range of cases in any
jurisdiction 
* 
pending production of protocols, template and precedents to complement
and implement the Sedona Canada Principles 

Hear from Colin Feasby, a lawyer, about what legal processes drive an
e-discovery; speak with Claire Pater, a paralegal turned IT/litigation
support professional, who works closely with the legal profession on
e-production and e-discovery issues; and mine the knowledge of Martin
Felsky, a Sedona Canada Principles participant. 
Speaker's Bio 
Colin Feasby is a partner in the Litigation Department of Osler, Hoskin
& Harcourt LLP, in its Calgary Office. He represents clients in various
industries including oil and gas, petrochemicals, electricity, and
financial services. He has represented clients in corporate litigation,
securities litigation, contract disputes, and franchise litigation.
Colin has represented clients before all levels of trial and appellate
courts in Canada, including the Supreme Court of Canada. He has also
represented clients in arbitrations in Nevada, Ontario, Nova Scotia, and
Alberta and governed by the rules of the American Arbitration
Association, ADR Institute of Canada, and British Columbia International
Commercial Arbitration Centre. 
Claire Pater has worked in the legal and IT industries for over 12
years. As a litigation paralegal turned IT and litigation support
professional, Claire is able to use her knowledge and experience to
bridge the gap between IT and the practice of law. Claire is a life-long
learner whose credentials include litigation paralegal, computer
programmer, certified technical trainer, and certified e-learning
facilitator. As the Manager of Litigation Support at Platinum Legal
Group's Calgary office, Claire oversees a talented team that offers
litigation support services throughout Alberta. 
Martin Felsky is the co-founder and CEO of Commonwealth Legal, Canada's
National Litigation Support Services Company. In that capacity, he
advises law firms, corporations and government clients in Canada, the
United States and overseas on the effective use of automated litigation
support and strategic electronic discovery.has been involved in a number
of large, complex e-discovery projects involving data, multiple parties
and lawyers from around the world, in a combination of civil, criminal,
regulatory and investigative proceedings. Martin is also a charter
member of the Sedona Conference Working Group 7, working on a national
standard for electronic discovery. He participated in the Electronic
Discovery Committee of the Task Force on the Discovery Process in
Ontario, which drafted the Ontario Guidelines on Electronic Discovery
(October 1995). Martin has been a member of the Judges Technology
Advisory Committee of the Canadian Judicial Council for 20 years.
