Julie is certainly right about that. However, one other area to mine for
guidance for law firm files are Bar Associations Ethics Opinions. They
are general, and refuse to make any hard and fast rules, but they are
sources that lawyers in your firm will consider valid. One good one is
Pennsylvania Bar Association's Committee on Legal Ethics and
Professional Responsibility Formal Opinion 2007-100: "Client Files -
Rights of Access, Possession and Copying, Along with Retention
Considerations."

It spends a good deal of time on the issue of ownership of matter files,
and  their component parts -- naming different documents and
categorizing them as the client's or the lawyer's. It also addressed
electronic records. And it offers some retention recommendations at the
end.

I would suggest reviewing the bar associations opinions -- local,
regional, state, -- in the states in which your law firm does business.
And of course the ABA.
