In Canada (not sure about the U.S.) but we have chips in our debit and credit cards. For the credit cards we now enter a pin instead of signing our signature.

I've also worked at a gas station for many years, and our policy was if anyone paid with credit or debit we would hold the card (in their view of sight, so that they could see that we weren't doing anything with it) till the purchase was approved. I've also had many instances where the card was reported stolen and I had to keep it (that was fun trying to tell the person they couldn't have their card back).

Agree,

In Canada it becomes normal to ask, but the consumer still has right to refuse, for this type of information.
The Wall Mart I use very often ask permission to enter my Postal code and don't get angry when I answer no.
Some Gas Stations also try to ask this information but voluntarily only.
I understand that they do it for market researchers, or for some statistics - for their future development, let say.
I con fussed that my signature on most of my cards is gone over the time, but nobody pays attention to it, but very often I listen their comments regarding the points I collected and what I should do with it, what drives me ...., as it is interruption in my private life.

I wonder what the real intent is - to get the practices changed or to sue
the pants off of "Big Oil" (and perhaps the intent varies depending on
whether you're a consumer or a lawyer ...).  I just absolutely can't
imagine that the gas stations had nefarious or malicious intent, but were
rather likely acting in what they felt was the best interest of the consumer
and that their practices were in accordance with the law (per another CA
court, as cited).

I'd be interested to hear of actual damages incurred by *any* consumer as a
result of that practice, which should be a weighing factor in the award of
damages by a court, or settlement out of court.

If the state has now made the determination that a ZIP is PII, then fine, do
that; but give merchants a chance to make changes to their systems to comply
with the change.  I'm more suspicious of levying fines in a hurry as being
potentially malicious than I ever would be of a gas station trying to prove
I'm not using a stolen card by asking for my billing address ZIP.

I like Mark's idea of allowing the consumer to decline entering their ZIP
but then making them have their ID checked by a station attendant instead
before they can pump gas.  Convenience over concern - the consumer's choice.

These kinds of lawsuits drive me nuts.
