Donna Day asked for feedback on those Office 365 vendors who recommend that emails be retained permanently as a method of addressing eDiscovery risks.
In my (admittedly jaundiced) opinion, Office 365 vendors do not yet have a satisfactory/practical approach to applying retention to emails. Rather than acknowledging this, or making the effort to understand the related issues, they instead take a marketing approach and try to turn a liability into an asset. So, they hide the inadequacies of the product under the mantle of “eDiscovery risk”.
Old emails are much more likely to hurt an organization than to help. Most attorneys who’ve defended against costly litigation advocate for disposing of emails as quickly as possible.
