If a company can't use encrypted software technology to ensure that
records sent outside the company are disposed of properly, how does a
company protect themselves from litigators who are able to retrieve
records from a recipient when those records have met their retention
life and the company has disposed of the records, but not the recipient?

The issue, as I see it is, who should have control of the email, the
sender
or the recipient.  If I write an email on my computer and keep it there
then, obviously, I'm the one who should have control over what happens
to it
and when it should be destroyed.  However, when I send it to someone I
am
relinquishing control over the copy that I send.  This software
capability,
to me, is tantamount to allowing someone to walk into my office and  go
in
my file cabinet and destroy a letter he sent me.  Hey, buddy, you sent
it to
me, "It's mine!"
