Hi Linda,

I would agree with the previous poster in that 30 years sounds extremely
excessive for these records. Down here in the "plywood" state
(Florida), both the State's GS1-S (for state government agencies) and
GS1-L (for local governments) retention schedules require the record
copy of Litigation Case Files to be kept for 5 years after the
litigation has been closed. Duplicates of these records are kept until
they become obsolete, superseded or their administrative value has been
lost.

After researching your state's requirements, part of your argument could
include that retention period plus a review of whatever other state(s)
your company does business in (as the retention requirements may differ
from state to state for these records). You may also gain additional
ammunition if you researched other tools like some of Skupsky's books.

Good luck!

Earl

Subject: Litigation records

My company started the records program in 1985. We started out
with keeping Litigation records A + 20 . After research and
benchmarking 4 years ago we changed to A + 5 years. I now report to
Legal. with new management now they want to go to 30 years. I think
this is excessive. Any good arguments out there or do I just go along
with this new recommendation.
