In a lengthy decision, the E.D. Va. court discussed several important
questions regarding the duty to preserve evidence when litigation is
reasonably anticipated, including when duty arises, the scope of the
duty, some of the steps to follow to fulfill the preservation obligation
and what limitations the preservation duty imposes on implementing at
records retention/destruction program (RRP), and when spoliation
sanctions are appropriate for the destruction of documents under a RRP.
