<I would first ask you why the firm would want to give the departing
attorney its files? Is that a common thing in law firms?>

Happens ALL the time!  Often times when an attorney leaves a firm, the
clients he or she was servicing will choose to follow the attorney to
the new firm.  In that instance, the client will request the files and
work be transferred, and the firm must abide by their wishes.  Holding
clients as business hostages, while an interesting concept, is generally
frowned upon. ;)

Like changing doctors, or mechanics - you'd like to take your files to
the new service provider to ensure a smooth transition and competent
service.
