Steve, you could mention that the recent revisions to the Federal Rules of Civil Procedure regarding the discoverability of ESI (electronically stored information) don't specify whether the ESI has to be formally declared a record in order for the new rules to apply. But if your company can demonstrate consistently-applied methods for declaring and managing "records", then they might be willing to accept the risks associated with not managing "non-record" material.
