According to HIPAA, ownership is a two-part process.
The "data or information," on the record regardless of format belongs to
the patient. The actual hardcopy, film or tape belongs to the hospital
and/or facility to be maintained, stored and eventually destroyed at a
future date according to type of medical record and residing state
statues.
The patient has ownership of the information. The facility owns and
manages the rest.
