This is an interesting debate about ownership and retention, and does
usually result in the realization that the patient has some rights to the
information, though the medical facility actually owns the records. However,
in my experience, medical physicians and mental health counselors rarely
create informative high quality records of much real value to patients. Just
ask them for a written "report" on your condition and they will give you a
verbal dump and no real substantive record. Most medical records just seem
to support the ability of the so-called health CARE industry to bill your
insurance company. They do not really care about creating useful records for
patients.

It does not seem to me that HIPPA or anything else encourages health care
providers to create really substantive records of use to a patient in
reconstructing their medical history. You will get "records" that show the
check boxes on a form where they checked an item, that allowed them to bill
the insurance company, and a few undecipherable scribbled notes. It seems if
you want to have real medical records about any conditions or treatments,
you have to create your own.

According to HIPAA, ownership is a two-part process.


The "data or information," on the record regardless of format belongs to the
patient.  The actual hardcopy, film or tape belongs to the hospital and/or
facility to be maintained, stored and eventually destroyed at a future date
according to type of medical record and residing state statues. 

The patient has ownership of the information.  The facility owns and manages
the rest.

Yes, patients are allowed to have copies of their medical records,  but I am
not sure if the entire contents.
