I have been trying to draw a cost comparison on proper storage of computer media versus the costs of litigation and related E-Discovery.

Does anyone know how to research the costs of litigation? I know it is different by case and probably the most poorly prepared companies with regard to records management and data mapping are the ones incurring the highest costs. I want to see if I can make the case that better prepared records management companies perform better in litigation.

Digital storage or electronic records storage is skyrocketing with growth that is extraordinary.

There is always the hope that ERM can be stored on servers in the Cloud but the much ballyhooed “Store it in the Cloud” is meeting the reality of tremendous cost increases without real benefit. The Cloud has been less than stellar as a E-Discovery tool and in some cases has dramatically increased E-Discovery costs. And now users find it is not a great archival storage model.

But to complete the analysis, I need some real world litigation costs. Could I back into by estimating hours and then an average cost of $250.00 per hour to $350.00 per hour.

Does any one have any anecdotal studies or a real world example without naming the name of the company in the law suit. Law firms say E-Discovery is now 80% of the cost of a legal action but they do not provide numbers?

Any ideas or sources that can be offered?

Have a Happy Memorial Day.
