Speaking as a former litigation paralegal from a large large firm who worked with clients preparing responses to document requests.  Ask the outside counsel if they need the originals.  As the client, it will be cheaper for you to make the copies or have them scanned.  Otherwise the outside counsel will make copies of your original documents [if they are using best practices] have them scanned, charge you and return them.  If you make the copies, do let the outside counsel know they are receiving copies and keep what you had copied or scanned in the order you give it to the outside counsel.  At some point, as the case goes forward, you may have to produce the originals.  In this day & age, many law firms have the clients' documents scanned into litigation software that will allow them to do searches and compile the documents into various orders and to meet various needs.  Caveat:  keep your internal general counsel or the assigned attorney from the general counsel in the loop. He/she may make specific requests about what is sent/copied/scanned before it leaves the company.

Good afternoon Listserv.  Can anyone share with me what you consider to
be best practice when providing your outside counsel with discovery
requests, e.g. hardcopies of official records - are all official records
photocopied/imaged etc... prior to being shipped to the attorney or do
you ever send the original record?
