Dear Mr. Conley:
This office has received your letter dated October 30, 2007,
with respect to the above-referenced appeal.
In your letter you indicated, "the Finance Commission ended the
practice of issuing a formal annual report over fifteen years ago."
This report was also the subject of a previous request.
At that time you indicated that you would provide the reports
upon payment of a fee.
The requester never responded to your fee estimate.
While you indicated that your office replies promptly to
requests for public records, it is still a concern to this office that
you delete email messages without consulting the appropriate retention
schedule to determine whether the record ought to be preserved.
This office applauds your efforts to respond to public records
requests and hopes that you continue to do so, however, it appears
that in this the requester never received a written response from
your office to the request for public records that is the subject of
this appeal.
If indeed the request constituted a duplication of a prior request,
albeit for a different time period, you are still obligated to
respond.
Please be advised that this office is available to you if you
have questions with respect to responding to public records requests.
In addition, the Records Management Unit of this office can assist you
in review of the appropriate records retention schedules to ensure
that files are appropriately managed by your office.
