Since FMLA allows 12-weeks within one year period, it's been recommended
that the retention begins after the end date of the FMLA case by year.
For example, all FMLA cases that end in FY2008 is deemed inactive and is
sent to storage for 3 fiscal years. They will be eligible for
destruction FY2011.

I've seen some policies where it was 3 years after leave dates. Most
places I have worked kept them in the Personnel file which was destroyed
6 years after termination.

Good afternoon,

I am trying to get some clarification regarding the retention
requirements for Family Medical Leave records.  At what point does the 3
year retention begin - after the employee is no longer employed or 3
years from the date of leave?
