John - makes an excellent point in his posting "...to let us remember that such legal perspectives can, and undoubtedly will, be contested. We should consider this before Records Management Policies 
and Procedures are questioned and re-written"
 
There has been a lot of noise around this particular court ruling and some have even attempted to call it a "watershed" moment in EAM (E-mail archiving and management). The key to remember, as John points out, is that legal perspectives are *and* will be contested. So we as records managers need to take note of the ruling but not attempt to do a course correction based on a single legal ruling.
