 Patrick (and everyone),

Thanks for the advice. I really think we are heading toward Patrick's
model. It helps to hear we're doing the right thing, and the added
elements we will need.

Cheers and thanks again,

Melissa

Re: HELP! lawyers want to take over the RM policy with a book on legal
holds....

As a policy, your records management policy should be relatively brief. A
policy is not supposed to be a "how to" manual. You should certainly
reference Legal Holds (and Tax Holds as well) in your policy statement.
These are good things. The "how to" aspect of Legal Holds should be a
separate procedures document. The actual holds should be maintained in a
database where employees can look to see what impacts them. Your Policy
document should not include the retention schedules or any procedural
matters. Those should be separate documents.
All of these items should be inter-related and hyperlinked. We do not ever
give instructions on disposition of records without reference to Legal and
Tax holds. We also refer employees to the Historical Archives Collection
Policy. Likewise, the Archives and Law department do not issue disposition
orders without reference back to us.
Be pleased that you're connected there and take the opportunity to discuss
with your Legal department the synergies between what you do and their
litigation support activities. Familiarize yourself with the E-Discovery
Reference Model. (http://www.edrm.net)
