Re your question:
are there any guides on statistical
sampling where one could review a percentage with the same description
and make a reasonable assumption about the series (keep or destroy),
without legal repercussions? Are there any legal precedents?

Take a look at the recent webinar on the ARMA web site.  I took it and
remember there beinginformation on doing statistical sampling as a cost
effective alternative to an inventory.  And, it is FREE - another one of
the benefits of being an ARMA member.
