Topic:  "My Email Problem, and Yours:  Recordkeeping and Access Challenges In A New Era of Government Transparency"
Abstract: The December 2006 changes to the Federal Rules of Civil Procedure are transforming the way federal court litigation is being practiced in the US.  Courts are applying greater scrutiny to electronically stored information, concentrating on preservation, format, searching, and production in any given case.  For the public sector, this is not just the sound of distant thunder.  Increasingly, federal agencies are being required to confront how their electronic records will be produced in litigation.
Jason R. Baron is Director of Litigation for the National Archives and Records Administration and an internationally recognized speaker and author on the preservation of electronic records.  Between 1988 and 1999, Mr. Baron served as trial attorney and senior counsel at the Department of Justice, defending the government’s interests in complex federal court litigation, including cases involving the preservation of White House email.  He currently represents NARA on the Sedona Conference Working Group on Electronic Records Retention and Production, where he is a member of the Steering Committee and Editor-in-Chief of the Sedona Best Practices Commentary on the Use of Search and Information Retrieval Methods in E-Discovery, available at www.thesedonaconference.org.   Recent article of his he is posing for discussion - http://www.usaservices.gov/events_news/newsletters.php .
