Hi, Juanita. In answer to your questions, we only use confidentiality
statements on emails which may contain information which is exempt from
disclosure. For example, our Health Department includes such statements
on emails containing PHI, due to HIPAA. Note that they have an added
layer of security on such email messages (which are encrypted when sent
externally) - the disclaimer is there in case operator error bypasses
the security and sends a protected email to the wrong party.

I'm not sure that enforceability is necessarily the issue as is risk
reduction, and a good faith effort to inform recipients that the email
was sent in error and needs to be deleted. As you note, it makes no
sense to me to include such disclaimers if the information is not exempt
from disclosure. Unfortunately, the overuse of such disclaimers reduces
their usefulness.
