Attempts by the government and the courts to obtain information about
anonymous sources has been ongoing since the beginning of our country.
It was one of the reasons behind freedom of speech in the Constitution.
It appears the jury (and more to the point, the prosecution) is using
the Uniting & Strengthening America by Providing Appropriate Tools
Required to Intercept & Obstruct Terrorism Act (a.k.a. USA Patriot Act)
to subpoena this information.

This Act, which amends a number of statutes, was enacted in 2001 (Public
Law 107-56),and amended in 2006,(Public Law 109-177). It pertains to
law enforcement and businesses that provide financial and communications
services. The Act governs the deterrent and punishment of terrorist acts
in the United States and around the world and enhances law enforcement
investigatory tools.

The Act amends the following privacy laws:
Cable Communications Policy Act
Computer Fraud and Abuse Act
Electronic Communications Privacy Act
Wire And Electronic Communications Interception And Interception Of Oral
Communications (Federal Wiretap Statute)
Pen Register and Trap & Trace Device Statute (Pen/Trap Statute)
Fair Credit Reporting Act (FCRA)
Family Educational Rights & Privacy Act (FERPA)
Foreign Intelligence Surveillance Act (FISA)
Right to Financial Privacy Act

More information can be found in the ARMA International Educational
Foundation paper "Requirements for Personal Information Protection, Part
1: U.S. Federal Law" (free download at www.armaedfoundation.org) or in
the Public Laws themselves.
