I worked at the Texas State Library (TSL) years ago and am not really
surprised by this.  Unfortunately the Local Government Records Act
does not have any teeth in it, one reason why some local government
entities have never complied with it. I believe TSL has little
enforcement power under the Act other than possibly acquiring records
which have not been adequately protected.

Individuals disposing of records without approval/authority or not
turning over to their successor (elected officials) can be charged
with a Class A misdemeanor but charges are typically initiated by the
local District Attorney.

The best way to get local officials to implement a program is through
the press; that gets their attention quickly.
