Vladimir, you are correct that if you have it, it is subject to
discovery if relevant to the litigation/proceeding.
Generally I agree with Ginny and Gary, so what you need to do is
understand what is more important to your organization - using that
data in other instances or deleting it to mitigate risk. You can't
have both!
One suggestion I have for you to think about is questioning how that
data is being used in the other instances and challenge it's true need
in those instances. You may find the data being used arbitrarily and/
or that it isn't adding true value to the other business needs and
therefore is freed to be deleted.
