the key is "your...documented policy and procedures/practices" to not keep
destructions notices etc. and you religiously followed that policy and the
associated procedures/practices

this goes back to comments elsewhere that it is up to each organization to
determine what they want to implement.
I firmly believe that the legal profession is becoming ever more savvy with
regards to such policies and procedures. I'll just point everyone to the
Rambus opinion I just posted. read it carefully.
