We are holding the tapes for the record time period specified in the legal request - i.e. financial documents from 2010, or water quality testing records for 2010 - present (date of subpoena) etc.

Subject: [RM] Current Computer Backup Tapes During Legal Holds
I was questioned yesterday as to what happens (or should happen) with current computer backup tapes while there is a legal hold in place. These would be the backup tapes generated AFTER the hold has been put in place. Do they all need to be retained or can they be kept in the normal rotation of backup tapes (daily increments for so long, weekly for so long, etc.)?
I assume that once the legal hold is in place, the day-forward backup tape rotation can continue but that any backup tapes from the period of the hold would need to be retained as part of the hold.
What are others doing?
