Public Records Under FOIA, Please (and Can I Get a Side of Metadata and Cole
Slaw With That?) | e-Lessons Learned

In Nat’l Day Laborer Org. Network v. U.S. Immigration and Customs
Enforcement Agency, a Freedom of Information Act action, the plaintiffs
disputed the format in which defendants – four government agencies – turned
over ESI to plaintiffs, including text files, e-mails, spreadsheets, and
paper records.

The Government had consolidated considerable records into a single
unsearchable PDF file, eliminating all metadata from the individual files
that were merged together and hampering the plaintiffs’ ability to track the
source, dates, or search the original data sought in their public records
requests pursuant to FOIA.  While the plaintiffs did not specifically name
metadata in their various FOIA requests, they had specified that Excel files
should be sent in that form rather than as a PDF and text records should be
produced as separate files in single file format.
