Topic: Litigation as One Piece in the Lifecycle of Records

 

Description: RIM professionals manage the entire lifecycle of records. A
litigation proceeding is just one (particularly aggravating) use of records
that RIM professionals must manage. This presentation will explain the
anatomy of a litigation proceeding and describe the important role that RIM
professionals can and should play in controlling the costs and risks of
litigation, bolstering the ability to prove facts at trial, and safeguarding
the privacy rights of individuals throughout the litigation proceeding.

 

About the speaker: Kelly's litigation experience includes shareholders'
disputes, oppression proceedings, commercial fraud, contract and legislative
interpretation and class actions. Her class action experience has spanned
the energy, pharmaceutical and securities sectors. She has appeared before
all levels of Ontario Courts and before the Supreme Court of Canada.

 

With respect to her regulatory practice, she has particular expertise in the
energy sector. Kelly has appeared before the Ontario Energy Board and the
Ontario courts regarding the regulation of Ontario's electricity industry.

 

Kelly is heavily involved in the The Sedona ConferenceR, a non-profit
organization bringing together leading jurists, lawyers, experts, academics
and others to address cutting-edge issues in the law. She is the current
chair of the steering committee of The Sedona ConferenceR Working Group 7,
known as "Sedona Canada", which is responsible for the set of electronic
discovery principles which are incorporated by reference into the Ontario
Rules of Civil Procedure. She is also a member of the Ontario e-Discovery
Implementation Committee.
