Depends. The brain might merely be the container, like a tape case.  
I'll have to read that Canadian case and see how the court treated the 
oral historian's brain.  Thank God it wasn't in the U.S. -- the lawyers 
would have had that guy's brain out of his head and off to some forensic 
discovery shop lickety-split.
