In this breach of contract case, the defendants sought a motion to compel
and sanctions against the plaintiffs for failing to produce data maintained
by the plaintiffs’ ediscovery vendor. The defendants requested data that a
third party had produced in a related state court lawsuit that had since
been settled. The plaintiff refused to produce the information and argued
that it had no obligation under Rule 34 to produce any data that its
ediscovery vendor maintained because that data was not under the
plaintiffs’ control.
