One viewpoint on the topic of who searches for records is that it should be the business unit's responsibility on whose behalf the the litigation or discovery is being conducted. The analogy used here is that it is really the business that truly knows and understands what is the universe of records that need to be searched for. There is simply no way that Legal or RIM would ever know all of the types of records that needed to satisfy the discovery request.
 
Of course in the case of e-mail, since all e-mail (hopefully) is located centrally it might be a combination of  Legal/RIM can perform the search. The IT would provide support (e.g. access to the e-mail server, access privileges etc) while the business unit would need to supply keywords, categories, subjects etc to assist with the search. Someone is business/IT would also need to certify that  records stored on local PST files (if any) have also been accounted for.
