It seems to be a part of the leadership role for Presidents, Governors,
and Mayors or City Managers to consider their e-mail and text messages
outside public perusal.  There was the recent incident with the Mayor of
Detroit.  There have been numerous issues raised around access to White
House e-mail.  At the state level - almost every state has had at least
one Governor that made an issue of their e-mail privacy over the past
decade.  

Each is governed by different laws.  The federal level by Congress and
the Senate, the state and municipal levels by each state legislature.
As already stated, legislative bodies are good at passing laws for
others to meet, but leave themselves out of the compliance requirements.
