I've been dealing with this area since beginning work on a file plan.  The 
phenominon of people declaring records "Confidential" that aren't is well 
precedented.

It seems that, as with much of records management, that it is a matter of 
syntax.  Steve or Sally Muckenfutch may honestly believe that the records 
that they are filing are confidential, when in reality they are not based on 
what their company defines as "Confidential."

We simply need to clarify their definition of confidential.
