Hi Nancy,
One area of risk, which I don't think has yet been mentioned, is where there may be a legal requirement to destroy (or not retain) records/data after a certain time period.
For example, requirements for data protection, privacy, spent convictions, disciplinary HR actions, mental health, consumer protection etc.
I do not have citations for relevant US case law. But it might be worth a little research if you think it's relevant for your presentation.
