I'm not a lawyer, nor implying to be one .. but using tape as an effective legal hold is questionable.  Tape is a snapshot in time (and therefore not always complete as content might have been created and deleted prior to the backup being made) .. and in case of a legal hold content might be spread of hundreds if not thousands of tape and you'll have to keep each copy till the suit is solved.  New data that matches the legal hold query isn't automatically added to tape

Just my 2 cents .. my opinion and not my employers and such :)
