As part of the litigation process, a company must produce relevant
documents to support its position to the opposing party. But what is
considered to be a “document” and where the company is obliged to look
to find these “documents” has expanded over the last 20 years with the
development of technology.
In 2003, the Ontario courts expanded the definition of document from
simply a letter, photograph, chart, accounting record to include data
and information in electronic form. In other words, everything
relevant on any of your office computers including the Meta data has
become producible when your company is involved in litigation.
