Hi Frank,
I have personally made it a campaign to let folks know about the differences between public sector and private enterprise records in part for the reasons you suggest. In terms of public records, the records are created by various public agencies, which often also create a jurisdiction for them, among which many definitions are written into law. For example, here in Washington state, the state itself defines what a public record is, and so that is what all the agencies in the state must use as they define their records. Our public records disclosure law is linked to this definition, as are regulations about quality and preservation, retention scheduling and records policy.
I am fairly certain that most states have similarly linked policies to a state wide definition for records within public agencies.
