Court adopts a Fourth Amendment right to the deletion of non-responsive
computer files - The Washington Post
The Second Circuit has handed down a very important new Fourth Amendment
case, *United States v. Ganias
<http://www.ca2.uscourts.gov/decisions/isysquery/00dab27a-b336-4695-8165-f3446a519478/3/doc/12-240comb_opn.pdf#xml=http://www.ca2.uscourts.gov/decisions/isysquery/00dab27a-b336-4695-8165-f3446a519478/3/hilite/>*.
In an opinion by Judge Chin, the court held that the government violates
the Fourth Amendment when it indefinitely retains computer files that were
seized pursuant to a search warrant but are not responsive to the warrant.
