The plaintiffs filed a motion a compel the production of the emails and
documents of the defendant’s former vice president of marketing, seeking an
adverse inference jury instruction for spoliation to the extent that the
defendant had destroyed those emails and documents. The trial court denied
the motion, concluding that the defendant destroyed the documents purusant
to its document retention policies and that the defendant was not under a
duty to preserve these documents.
