Korean Companies Face US Legal Risks Over Preserving Documents - Korea Real

Korean law does not impose a free-standing obligation of document hold on
parties that may be facing litigation. (In Korea, a party may petition the
court for an order against the opposing party to preserve evidence.) Thus,
Korean firms which may be otherwise sophisticated are often surprised to
find that their standard document retention policies are not sufficient and
could result in plaintiff’s accusations that they intended to destroy
relevant evidence. Even a large and sophisticated Korean company, if
unfamiliar with such requirements, can find itself in trouble upon failing
to preserve documents.
