Company Suing Google for Infringement Is Sanctioned for Deleting Emails | The Recorder in a deposition, PersonalWeb employee Jake Drew claimed president and chief executive officer Mike Weiss told employees as early as May 2011 that the company "planned on filing lawsuits against major technology companies."
Drew also said Weiss told employees to purge their emails in October of 2011.

Other PersonalWeb employees disputed Drew's statements, though, and said instead that Weiss told employees to retain documents.

The magistrate judge found that, no matter Weiss' statements, PersonalWeb was still operating on an email deletion policy, even though it was embroiled in litigation. That, he wrote, is the very definition of spoliation.

Wester said.

Feds are facing a looming email management deadline. By the end of 2016, agencies must be able to manage permanent and temporary email records "in an accessible electronic format," according to an Office of Management and Budget directive <http://www.whitehouse.gov/sites/default/files/omb/memoranda/2012/m-12-18.pdf>.
That means an end to the cumbersome print-and-file mode used by many top officials in government and an end to manually dragging and dropping email messages and files into computer folders.

The University of Redlands has appointed Michele Nielsen visiting archivist and put her in charge of the artifacts collected over the university=E2=80= =99s 107-year history.
Nielsen, who graduated from the university, also serves as a research associate at the A.K. Smiley Public Library in Redlands. She began her new, part-time job in July.

County digitizes 200 years of records =E2=80=93 and stays on budget -- GCN

Four years ago, Tompkins County in upstate New York had to make a decision on what to do with nearly 200 years of paper records. The vintage county library building where old records were stored was being repurposed, and a new home had to be found for more than 9,000 boxes of documents.

Financially, the decision turned out to be simple, said IT director Greg Potter. The county already had begun using some digital documents in the mid-2000s, so digitizing existing records was an option. And  building a new records storage center for paper documents would cost an estimated $6 million. =E2=80=9CWe did a cost comparison for digitizing the records we ha= d and that came out to $500,000.=E2=80=9D

The legal advocacy group Cause of Action has filed suit against a dozen agencies that have resisted its document requests under the Freedom of Information Act, accusing the White House of politicizing the records requests.

GILLETTE, Wyoming =E2=80=94 Dusty Campbell County records are yielding some historical oddities, including byways that used to be named All Night Road and Poverty Point Road.

But a county project to preserve hundreds of road documents in digital form has a practical side as well.

"Energy companies need to know if a road is public or private," said Tony Knievel, the county's chief land surveyor. "Utility companies need to know the width of public roads. It helps hunters determine if it is a county road. All this data eventually ends up on a map," he said.

Many companies continue to struggle with the burden and expense of various retention requirements in the era of "big data." However, a recent Texas Supreme Court decision may bring clarity to companies concerned about their preservation obligations. On July 3, the Texas Supreme Court articulated a complete analytical framework to guide Texas courts in evaluating arguments regarding the spoliation of evidence. *Brookshire Brothers, Ltd. v.
Aldridge*, No. 10-0846, 2014 Tex. LEXIS 562, 2014 WL 2994435 (Tex. July 3, 2014). The decision brings clarity to Texas law, though not without a few points of uncertainty.
