The discovery fight has been expensive and embarassing for Delta. While
AirTran has stayed out of the fray, a federal judge has sanctioned Delta
more than $4.7 million in fines, legal fees and expenses for having lost or
destroyed electronic files from the critical months in 2008 leading up to
Delta's decision to begin charging for all but carry-on luggage.

In a 2012 sanctions order, U.S. District Judge Timothy Batten, who is
presiding over the case, vented his frustrations about Delta, saying it
"was as wrong as it was dogmatic in its assertions that it had fully
complied" with discovery requests.
