Just a shot in the dark here, but-

Not so long ago, a photocopy tended to be visually "less good" than the 
original.
This especially applied to anything with photos or graphics.
In those cases, you would always prefer to scan the original or the 
earliest generation of copy that you could.
I've recieved service documents for equipment that were photocopied from 
faxes, and you can imagine the ugliness...

Anyway- traditionally, you would want to scan originals for quality sake, 
even aside from any possible legal issues.
Nowadays, with text docs, not so important.
