Jay, I agree that with today's technology the photocopied image is difficult
to distinguish from the original.  My concern is if there is a legal
requirement for scanning originals vs. photocopies.

Just a shot in the dark here, but-

Not so long ago, a photocopy tended to be visually "less good" than the 
original.
