The U.S. federal court for the Western District of Pennsylvania
recently adopted new local rules governing electronic discovery (LCvR
26.2 DISCOVERY OF ELECTRONICALLY STORED INFORMATION.) Specifically,
counsel now has a duty to investigate the client’s electronically
stored information (ESI) to understand how it is stored, how it can be
preserved, how it can be accessed, retrieved etc.
I suspect other federal courts have already adopted a similar rule.
If not I am sure they will.
