Absolutely. I recall numerous requests for production that asked for
both the "official" record as well as all copies held by or under the
control of the organization. Several depositions reviewed the list of
folks listed on the distribution list with questions regarding whether
or not their files were searched for copies.
We even had a deposition in Houston halted so the in-box and out-box on
a manager's desk in North Dakota could be indexed. His flippant remark
that we had indexed everything in the office but the baskets was not
taken lightly by opposing counsel.
