Jean,

Many states permit such electronic filings....most, in fact do permit
it. However, the practice is still very limited. Many local
jurisdictions (County Clerks, County Registers of Deed, and County
Recorders) lack the willingness and in some cases the ability to accept
such filings. Others do allow for such filings. Thus states that allow
such filings is only a part of the process. County officials must then
embrace the concepts, and must have the tools necessary to import
electronically filed documents.

Texas allows such filings, as does Colorado, as does California, as does
Nevada. Rules differ from state to state - with California's being the
most challenging.

What has not "taken off" at all thus far have been those documents that
require a signature (Deed, Warranty Deed, Deed of Trust, etc.) where the
tradition of requiring the purchasers' signatures remains a requirement.

Subject: [RM] Electronic Real Estate Records

I am looking for information on what states, if any, are in reality
permitting the filing of electronic documents for real estate
transactions
and destroying the paper.

Thanks in advance,
