Litigation can tie up the original records for months -- even years. And
there's no certainty that the attorneys will return those documents to
you in their original condition or original order -- or intact.  If the
original is not subpoenaed -- or your own attorney does not insist upon
receiving the original -- a notarized "true copy" should suffice.

We will provide original records to auditors or attorneys only when the
review is being conducted onsite, if ordered to do so by the Court, or
if a representative of this office is with those records (off-site) at
all times.

Good afternoon Listserv.  Can anyone share with me what you consider to
be best practice when providing your outside counsel with discovery
requests, e.g. hardcopies of official records - are all official records
photocopied/imaged etc... prior to being shipped to the attorney or do
you ever send the original record?
